Cancellations: All Promo4less custom overseas orders are considered specially manufactured goods’ pursuant to the uniform commercial code. Purchase orders cannot be canceled or modified once received unless agreed to in writing by a duly authorized officer of Promo4less.
If cancellation is approved, customer is responsible to pay for all materials, labor, and other expenses accrued from order date to cancellation date.
Disclaimer: Several aspects of import orders are outside of our control including overbooked ocean vessels, China and US customs delays, strikes, acts of god, China production delays, etc. Distributor should allow extra time for these unforeseeable delays if in-hands date is critical.
Claims/Limitation Warranties and Liabilities: Promo4less warrants and represents to Promo4less’ direct purchasers (“Purchaser”) that the products will be free from defects in material and workmanship at the time of shipment. It is the purchaser’s responsibility to inspect the order and segregate any products that are found to be defective in regards to product quality and/or printing quality (“defectives”) within 21 days of receipt. Defectives that are segregated and reported to Promo4less within the 21 day inspection period will either be repaired or replaced at the discretion of Promo4less. If the same product is no longer available, defectives may be replaced with a similar product of equal or greater value. Refunds are only available if agreed to by a duly authorized officer. Any undertaking to remedy defective products after the 21 day inspection period will be at the sole discretion of Promo4less. This is the only warranty or representation, and the sole basis for liability respecting quality, performance, defects, repair, delivery and replacement of the products. No other representation shall be binding upon Promo4less, unless made by a duly authorized officer. Purchaser shall not warrant or represent that Promo4less warrants or guarantees any product, except as provided herein. Due to continuous product improvement, product design and specifications are subject to change without notice.
Promo4less’ UNDERTAKING TO REPLACE, REPAIR OR REFUND THE PURCHASE PRICE FOR DEFECTIVES IS PURCHASER’S EXCLUSIVE REMEDY AND IS IN LIEU OF ALL OTHER WARRANTIES (WHETHER WRITTEN OR ORAL, EXPRESSED OR IMPLIED). Promo4less’ liability arising out of the sale or use of products, whether in warranty, contract, negligence or otherwise (including claims for consequential or incidental damages), shall not in any event exceed the cost of furnishing a replacement for the defectives, or refunding the purchase price of the defectives, as provided above.
Promo4less SHALL NOT BE RESPONSIBLE FOR ANY CONSEQUENTIAL DAMAGES SUFFERED OR INCURED BY THE PURCHASER OR ANY OF IT’S CUSTOMERS.
The foregoing shall constitute Promo4less’ sole liability to purchaser, to purchasers vendees and/or any recipients of the product. We are not responsible for inability to fill order due to strikes, shortage of materials, or any other reasonable cause. Listing an item in our catalog or on our website is not a guarantee of product availability.
Sales tax will be added to all orders as required by law.
